These Terms of Use (the "Terms") govern your use of the OpenCraft AI website, services, and applications (collectively, the "Services"). The Services are provided by Newsta Pvt Ltd, a company incorporated under the laws of India and having its registered office at 92A, 2nd Main Road, Electronics City – I, Bengaluru, KA, India (hereinafter referred to as "Newsta", "we", "us", or "our").

By using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Services.

1. Eligibility

The Services are available only to individuals who are 18 years of age or older. Users accessing the Services through single sign-on OAuth with Google and Microsoft must also meet this age requirement.

2. User Accounts

You must create an Account to access and use certain Services. You agree to provide accurate and complete information when creating your Account and to keep your Account information up to date. You are responsible for all activities that occur under your Account.
We offer the option to sign in using single sign-on OAuth with Google and Microsoft. By using this feature, you authorize us to access certain account information from these providers, such as your name and email address, to facilitate your login and enhance your user experience.

3. Acceptable Use

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to use the Services to:

• Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libellous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
• Harm or threaten to harm minors in any way.
• Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
• Interfere with or disrupt the Services or servers or networks connected to the Services, or disobey any requirements, procedures, policies, or regulations of networks connected to the Services.
• Violate any applicable laws or regulations.

4. Content and Ownership

You retain full ownership of the content you create with our AI tools. By sharing your content with us, you grant OpenCraft AI a non-exclusive, worldwide, royalty-free license to utilize your content solely for improving our AI models and delivering exceptional chatbot experiences. This license can be revoked at any time by deleting your content, allowing for a reasonable period for us to remove it from our systems. Please note that this license does not grant us the right to sell your content or use it outside the scope of providing the Services.

5. Data Storage

Your data and content uploaded to the Services will be stored on servers located in India. By using the Services, you consent to the storage of your information in India. This storage policy helps ensure that your data is managed in accordance with the legal standards and regulations applicable in India. Data accessed through single sign-on OAuth with Google and Microsoft will be handled with the same level of security and privacy as other data, in compliance with applicable laws and the privacy policies of these providers.

6. Cancellation Policy

You can cancel your subscription at any time and you will no longer be charged. After cancelling, you will have continued access to your account and can generate content until the end of your billing cycle.
Please note that we do not provide refunds for any subscription payments already made.

7. Intellectual Property Rights

You maintain all intellectual property rights to the content you create with our AI Chatbot tools. By using OpenCraft AI, you grant us a non-exclusive, worldwide, royalty-free license to leverage your content for internal research and development purposes, ultimately leading to more powerful chatbots for everyone. This license is limited to internal use and does not affect your ownership. This ensures that your intellectual property remains yours while allowing us to enhance our Services effectively.

8. Third-Party Links

The Services may contain links to third-party websites or services that are not owned or controlled by Newsta. Newsta has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Newsta shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such websites or services.

9. Disclaimer of Warranties

The services are provided "as is" and without any warranties of any kind, express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Newsta does not warrant that the services will be uninterrupted or error-free.

10. Limitation of Liability

In no event shall Newsta be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, arising out of or in connection with the use of or inability to use the services, even if Newsta has been advised of the possibility of such damages.

11. Indemnification

You agree to indemnify and hold Newsta harmless from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or in connection with your use of the Services, your violation of these Terms, or your violation of any rights of any third party.

12. Termination

Newsta may terminate your access to the Services at any time, for any reason or no reason. Newsta may also terminate your access to the Services if you violate any of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India.

14. Changes to Terms

Newsta may modify these Terms at any time, and such modifications shall be effective immediately upon posting of the modified Terms on the Services. You agree to review the Terms regularly to ensure that you are aware of the current Terms. Your continued use of the Services following the posting of modified Terms will be deemed your acceptance of such modifications.
